Judge rules that S.B. 84 does not apply to Dakota Pacific’s Kimball Junction property

PARK CITY, Utah — Third District Judge Richard Mrazik ruled yesterday that S.B. 84 does not apply to Dakota Pacific Real Estate’s (DPRE) property at Kimball Junction.

S.B. 84 passed earlier this year would have allowed for DPRE to move forward with its Park City Tech Center Project without county approval.

“Dakota Pacific’s ham-fisted tactic to subvert the Summit County community and Summit County’s legislative process and instead lobby the Utah Legislature to: impair a 15-year old, carefully negotiated contract; and override local land use authority and our community’s right to local self government has failed,” Summit County Attorney Margaret Olson said.

“Dakota Pacific’s malicious deployment of lobbyists to spread false allegations that Summit County inhibits and blocks development projects which include affordable housing remains of great concern,” said Roger Armstrong, Summit County Council chair. “Such allegations are patently false and belied by affordable housing projects negotiated and/or incentivized by Summit County over the last several years.”

However, the legal battle between Summit County and DPRE is not over. Summit County made eight claims in its case against DPRE, and Thursday’s ruling only addresses one of those claims.

According to a statement on behalf of Summit County, county representatives will take time to celebrate this ruling before turning its attention to the remaining 7 claims surrounding S.B. 84.

Representatives from DPRE did not immediately respond to a request for comment.
