Judge approves stay of Dakota Pacific, Summit County lawsuit
The legal proceedings have been paused until the summertime
SUMMIT COUNTY, Utah — Summit County and Dakota Pacific Real Estate (DPRE) have agreed to temporarily pause their legal proceedings, and will now engage in public negotiations outside of the courtroom.
Both parties motioned to stay the lawsuit on Dec. 8, and the motion was approved by Third District Court Judge Richard Mrazik on Dec. 11. The stay will expire on June 8.
During this time Summit County and Dakota Pacific will engage in public proceedings relating to DPRE’s application to amend its development agreement for the proposed Park City Tech Center in Kimball Junction.
Either party can end the stay at any time before June 8 as long as the opposing party is given 14 days notice.
The suit was filed in March after S.B.84 was passed during the 2023 General Session of the Utah State Legislature. The bill appeared to directly benefit DPRE by allowing it to proceed with building the Park City Tech Center without county approval.
In June, Mrazik ruled that S.B. 84 did not apply to DPRE’s property at Kimball Junction, addressing one of eight claims Summit County made against DPRE. Any remaining legal proceedings would work to address Summit County’s remaining seven claims against the real estate company.
