Dakota Pacific moves closer to controlling land use in proposed new Kimball Junction town

SUMMIT COUNTY, Utah — Park City Tech in Kimball Junction has cleared its first hurdle toward becoming Utah’s newest municipality. The Lieutenant Governor’s Office has confirmed that the proposal meets state requirements to move forward. Developer Dakota Pacific Real Estate, which submitted the incorporation request in January 2025, now awaits the results of a feasibility study—a critical step in determining the town’s financial viability.
If approved, governance will follow Senate Bill 258 (SB 258), granting Dakota Pacific significant control over the town’s early operations. The developer will appoint the mayor and three of four council members, overseeing zoning, land use, and municipal regulations. While elections could eventually transition power to residents, this shift depends on population growth and the town’s financial sustainability. If self-governance does not work out, the preliminary municipality can dissolve and return to being an unincorporated area of the county. In this case, the county would resume responsibility for providing services such as road maintenance, zoning, and public safety. The county would also inherit existing zoning decisions and housing developments approved during the self-governance period.
The feasibility study, conducted by an independent consultant, will analyze tax revenue projections, municipal service costs, and overall sustainability. Dakota Pacific does not control the study but may submit financial data. The process is expected to take up to 90 days, followed by a public review period and a final decision from state officials. The Lieutenant Governor makes the final ruling on whether Park City Tech can be incorporated as a municipality.
If approved, the incorporation process will move forward, with Dakota Pacific appointing the initial town government. Per SB 258, the full process is expected to take approximately six months, barring any appeals or legal challenges.
